FCC’s Sudden Push to Ban LiDAR Drones Signals a Major Regulatory Shift

 

The FCC is moving to retroactively ban drones equipped with LiDAR, thermal cameras, aerosol‑dispensing systems, docking stations, and other capabilities it now classifies as “military‑grade.” The proposal marks a dramatic reversal: several of these drones were previously approved for sale in the U.S., including popular consumer models like the DJI Air 3S, Avata 360, and Mini 5 Pro.

The agency’s new stance stems from national‑security concerns. In a recent public notice, the FCC said it is considering extending restrictions to drones with capabilities the U.S. government views as potentially military in nature — including LiDAR sensing, thermal imaging, swarming operations, integration with defense articles, and drones weighing over 55 pounds. If adopted, the ban would block future imports and sales, though existing owners would not be affected.

The implications are far‑reaching. LiDAR and thermal sensors are widely used in agriculture, search‑and‑rescue, infrastructure inspection, surveying, and cinematography — not just defense. DJI and other manufacturers warn that the FCC’s broad definition could sweep up essential commercial tools, making replacement parts scarce and jeopardizing software updates for drones still in active use.

The proposal is open for public comment until September 2, after which the FCC could finalize a rule that takes effect roughly 180 days later. If enacted, the ban would reshape the U.S. drone market, shifting the regulatory question from “Who made this drone?” to “What can this drone do?” — a shift that could impact manufacturers across the globe.
